Welcome to iWills India, a platform dedicated to simplifying the creation of legally valid wills online. We, Tickzo Private Limited ("we," "us," or "our"), provide interactive tools and resources to guide you through the process. By accessing or using iWills India and its associated services (collectively, the "Services"), you ("User," "Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").
1. Acceptance of Terms and Eligibility
By using iWills India, you affirm that you are at least 18 years old and legally competent to make a will in your jurisdiction. You agree to comply with these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you may not access or use the Services.
2. Services Overview
iWills India provides an online platform for creating legally valid wills. Our services include:
- Interactive Questionnaire: We guide you through a series of questions to gather relevant information for your will, such as your assets, beneficiaries, and executor details.
- Will Generation: Based on your answers, we generate a personalized will document tailored to your specific needs.
- Download and Printing: You can download your completed will document and print it for signing and witnessing.
- Information and Education: We provide general information and educational resources on wills planning.
3. No Legal Advice & Disclaimer
3.1 Not a Law Firm: iWills India is a technology platform and is not a law firm, legal service provider, or legal practitioner of any kind. Tickzo Private Limited is a private technology company and is not registered or regulated as a legal services provider under the Advocates Act, 1961 or any other applicable law in India.
3.2 No Legal Advice: Nothing on this platform — including but not limited to the will drafting tools, questionnaires, AI-generated suggestions, templates, help content, blog articles, FAQs, or any other content — constitutes legal advice of any kind. All content is provided for general informational and educational purposes only.
3.3 No Attorney-Client Relationship: Your use of iWills India does not create an attorney-client relationship, solicitor-client relationship, or any other professional legal relationship between you and Tickzo Private Limited, its employees, agents, or any person associated with the platform.
3.4 Consult a Legal Professional: iWills India strongly recommends that you consult with a qualified and licensed legal professional (such as an advocate or solicitor) before finalising and executing your will, particularly if your estate involves complex assets, business interests, non-resident beneficiaries, disputed property, or any other legal complexity. The platform is designed to assist — not replace — professional legal advice.
3.5 No Guarantee of Accuracy or Suitability: While we make reasonable efforts to keep our platform content accurate and up to date, iWills India makes no representations or warranties — express or implied — regarding the accuracy, completeness, legal validity, or suitability of any content or document generated through our Services for your specific circumstances, jurisdiction, or personal situation. Laws governing wills may vary by state, religion, and personal law applicable to you, and the platform may not account for all such variations.
3.6 User Responsibility: You acknowledge that you are solely responsible for the decisions you make based on your use of this platform. iWills India shall bear no liability whatsoever for any losses, damages, legal disputes, or adverse outcomes arising from reliance on the platform in lieu of qualified legal advice.
4. Account Creation and Security
4.1 Account Registration: To create a will using our Services, you may need to create an account. You agree to provide accurate and complete information during registration and to keep your account information updated.
4.2 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials, including your password. You are responsible for all activities that occur under your account. Please notify us immediately of any unauthorized use or security breach.
4.3 Data Privacy: We are committed to protecting your privacy and handling your personal information responsibly. Please refer to our Privacy Policy for details on how we collect, use, and disclose your information.
5. User Content and Conduct
5.1 User Content: You are solely responsible for the information you provide when using our Services ("User Content"). You represent and warrant that your User Content is accurate and complete to the best of your knowledge.
5.2 Prohibited Conduct: You agree not to engage in any of the following prohibited activities:
- Providing false or misleading information.
- Creating, drafting, or submitting a will on behalf of another person for any reason whatsoever.
- Using the Services for any illegal or unauthorized purpose.
6. Platform Role, Identity Verification & Prohibition on Third-Party Will Creation
6.1 Platform Role & No KYC Obligation: iWills India operates solely as a technology intermediary platform designed exclusively to help individuals draft their own will. We are not a Know Your Customer (KYC) authority, identity verification body, or legal certifying entity. We do not verify, authenticate, or certify the identity of any User or the accuracy of any information submitted through our Services. It is the sole responsibility of the User to ensure that all information provided is accurate, truthful, and legally valid. The platform bears no responsibility or liability for the authenticity of any information submitted.
6.2 Strict Prohibition on Drafting a Will for Another Person: iWills India is a self-service platform intended solely for use by the Testator (will-maker) themselves. Creating, drafting, or submitting a will through our Services on behalf of any other individual is strictly prohibited. By using this platform, you expressly confirm that:
- You are the sole author and Testator of the will you are creating, and you are acting entirely in your own capacity.
- You are not acting as an agent, representative, attorney, or in any other capacity on behalf of another person.
- Any attempt to create a will for another person constitutes a misuse of the platform and may amount to forgery, fraud, or impersonation under applicable law.
- iWills India shall bear absolutely no responsibility or liability if any person misuses the platform to create a will in the name of another individual. All civil and criminal liability for such acts rests solely with the individual who committed the act.
- iWills India reserves the right to immediately terminate access and report any suspected fraudulent, forged, or unauthorized use to the appropriate law enforcement and legal authorities.
6.3 Indemnification: You agree to indemnify, defend, and hold harmless Tickzo Private Limited, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from any unauthorized, fraudulent, or prohibited use of our Services, including but not limited to creating a will in another person's name.
7. Fees and Payment
7.1 Fees: We will charge fees for certain features of our Services. The applicable fees will be clearly displayed before you access those features.
7.2 Payment: You agree to pay all fees associated with your use of the Services. We may use third-party payment processors to facilitate payments.
8. Intellectual Property
The content and materials available on iWills India, including but not limited to the platform, software, text, graphics, logos, and design, are protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on these materials without our express written consent.
9. Disclaimer of Warranties
iWills India is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of iWills India or the will document generated through our Services.
11. Indemnification
You agree to indemnify and hold harmless Tickzo Private Limited, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of iWills India, your violation of these Terms, or the will document generated through our Services.
12. Termination
We may terminate or suspend your access to iWills India for any reason, at our sole discretion, without notice. This includes, but is not limited to, violation of these Terms, misuse of the Services, or inactivity.
13. Mental Capacity Declaration
By using iWills India to create a will, you expressly declare and confirm that:
- You are of sound mind and full mental capacity at the time of creating this will, and are capable of understanding the nature, extent, and effect of making a will.
- You are not acting under duress, coercion, undue influence, or any form of pressure from any person when drafting this will.
- iWills India does not verify or assess the mental capacity of any User. The platform relies entirely on this self-declaration by the User. We bear no liability if a will is later challenged on the grounds of mental incapacity, undue influence, or lack of testamentary capacity.
- Any challenge to the validity of the will on grounds of mental incapacity or undue influence shall be a matter strictly between the parties involved, and iWills India shall not be named or held as a party in such proceedings.
14. Will Validity — Execution, Witnesses & Registration
14.1 Draft Only: The will document generated by iWills India is a draft document only. It does not constitute a valid, legally enforceable will until it has been properly executed in accordance with applicable law.
14.2 Execution Requirements: Under Indian law (including the Indian Succession Act, 1925), a will is valid only when:
- It is signed by the Testator (or by some other person in the Testator's presence and by their direction).
- The signature is attested by at least two witnesses, each of whom must sign the will in the presence of the Testator.
- The Testator and witnesses must all be present simultaneously at the time of execution where required.
14.3 No Guarantee of Validity: iWills India does not guarantee that any will generated through our platform will be legally valid or enforceable in any jurisdiction. Legal validity depends entirely on the correct execution, witnessing, and where applicable, registration of the document by the User. iWills India shall bear no liability for any will that is found to be invalid, defective, or unenforceable due to improper execution, failure to obtain witnesses, or non-registration.
14.4 Registration: While registration of a will is not mandatory in India, it is strongly advisable. iWills India does not provide registration services, and registration must be done independently by the User with the appropriate Sub-Registrar's office.
15. Amendments to These Terms
Tickzo Private Limited reserves the right to amend, revise, or update these Terms and Conditions at any time, at its sole discretion, without prior notice. The revised Terms will be posted on this page with an updated "Last Updated" date. Your continued use of iWills India following the posting of any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree with the updated Terms, you must immediately discontinue use of the Services.
16. Force Majeure
Tickzo Private Limited shall not be held liable for any failure, delay, or interruption in the performance of its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, floods, earthquakes, pandemics, epidemics, war, terrorism, civil unrest, government orders or regulations, internet or telecommunications failures, power outages, cyberattacks, or any other event of force majeure. In such circumstances, our obligations under these Terms shall be suspended for the duration of the force majeure event.
17. Modifications to Services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
18. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, as applicable to the National Capital Territory of Delhi. Any dispute arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in New Delhi.
19. Entire Agreement
These Terms constitute the entire agreement between you and Tickzo Private Limited regarding your use of iWills India and supersede all prior or contemporaneous communications and proposals, whether oral or written.
20. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
21. Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
