Age
Under the Indian Succession Act, 1925, any person who has attained the age of 18 years can make a Will.
Sound mind
The person making the Will (the testator) must be of sound mind at the time of making the Will — meaning they understand the nature of the document, the extent of their assets, and who they are leaving them to.
Free from undue influence
The Will must be made voluntarily, free from coercion, fraud, or undue influence by any other person.
No restriction on nationality or religion

Do I Need to Register My Will?
Under the Indian Registration Act, 1908, registering a Will is optional, not mandatory. A Will that is properly signed by the testator in the presence of two eligible witnesses is legally valid in India — whether or not it is registered.
